LOAN TERMS & CONDITIONS

1.    LOAN AGREEMENT BETWEEN ICTE AND THE BORROWER

These Borrowing Terms and Conditions, together with:

(a) UQ College – DEED OF RELEASE FROM LIABILITY AND AGREEMENT, whether signed or not; and

(b) any Safety, Maintenance and Operation Information Sheet

set out the terms of the loan agreement between UQ College and the “Borrower”.

2.    DEFINITIONS

3 MEMBERSHIP

3.1. Borrowers must be over the age of 18 to borrow equipment from UQC

3.2. Borrowers must register with UQC prior to borrowing Equipment. Registration includes the completion of an application form and verification of the Borrower’s identity. Verification is accomplished by presenting a current UQ Staff photo ID

3.3. The Borrower may not borrow any Equipment until he/she has signed the Terms and Conditions

3.4. UQC retains the right to refuse to lend Equipment to any person for any reason other than contrary to Australian law

3.5 Members warrant that assets are only to be used for work purposes.

BORROWING AND RETURN OF ASSETS

4.1. UQC will be open for Borrowers to borrow and return assets at the Operations times set out, usually between the times of 8:30AM – 16:30PM. These opening times are subject to change at UQC’s operational discretion.

4.2. Borrowers must be prepared to return all items by the return times set out in the Booking form. UQC reserves the right to refuse or limit renewals, and will do so based on demand.

4.3. If any assets are not returned by the Return Date, UQC will issue an overdue notice. If the assets are not returned by the date stipulated in the overdue notice, appropriate steps will be taken to retrieve them, which may include the use of a collection agency and/or legal action.

4.4. Fines must be paid in full before borrowing any additional assets.

4.5. Immediately upon request from UQC the Borrower must pay: 

(a) the price charged to UQC for any asset which, for whatever reason, is not returned to UQC; 

(b) all costs incurred in cleaning any assets which are returned in an unclean state; 

(c) the full cost of repairing any damage to any Equipment; 

(d) any fines payable pursuant; and 

(e) all costs incurred by UQC in recovering possession of any assets (including legal costs).

5.    USE OF ASSETS

5.1. Only the Borrower is authorised to use UQC’s Equipment. The Borrower must not permit any UQC Equipment to be used by any other person unless with the express permission of UQC. The Borrower must not part with possession of any UQC assets he/she has borrowed.

5.2. The Borrower agrees that if any borrowed Equipment becomes unsafe or in a state of disrepair, they will immediately discontinue use of the item and notify UQC of the issue on return, if not earlier. The Borrower must not attempt to repair or tamper with any UQC Equipment.

5.3  The Borrower must agree to use Equipment in a proper manner and in a way in which the equipment was designed to be used.

SiSo Software Limited are not responsible or liable in any way for any errors, damages or any other loss caused by your usage of this system. For the avoidance of doubt this includes any loss howsoever suffered including negligence or fraud except where such negligence causes death or personal injury.
